TERMS AND CONDITIONS OF USE AND CONTRACTING (USERS)

1. OBJECT AND SCOPE OF APPLICATION
These General Conditions regulate the access, navigation, and acquisition of digital products (audio guides and digital content) on the RoamWithMe platform (hereinafter, "the Platform").
The Platform operates as a digital intermediary (Marketplace) that connects content creators ("Guides") with final consumers ("Users"). By accessing and purchasing on RoamWithMe, you acknowledge having sufficient legal capacity to contract and agree to be bound by these terms. By creating an account, the User declares being at least 18 years of age or acting with the consent and supervision of their legal guardian.
2. LICENSE OF USE (NON-OWNERSHIP)
By acquiring an audio guide or digital content, the User does not purchase ownership of the content (audio, text, images), but rather a limited access license.
2.1. Scope of the License: The Platform grants the User a worldwide, personal, non-transferable, non-exclusive, and revocable license to view the acquired content solely for personal and private entertainment purposes.
2.2. Strict Prohibitions (Intellectual Property): The User is strictly prohibited from:
- Redistribution: Reselling, renting, sublicensing, or sharing account access with third parties.
- Public Performance: Projecting the content in public spaces, schools, or businesses without a specific commercial license.
- Recording: Using screen capture or recording software to duplicate the content.
2.3. Account Security: The User is responsible for maintaining the confidentiality of their access credentials and for all activities carried out under their account. RoamWithMe will not be responsible for losses arising from unauthorized access caused by the User's negligence.
3. PROTECTION OF TECHNICAL ASSETS AND "ANTI-SCRAPING"
The User agrees not to perform acts that jeopardize the security or intellectual property of the Platform. It is expressly prohibited to:
- Reverse Engineering: Decompile, disassemble, or attempt to derive the source code of the App.
- Scraping and Data Mining: Use robots, spiders, scrapers, or any automated means to access the Platform and extract content, user data, or database information.
- Circumvention of Security: Attempt to bypass technological protection measures (DRM) that restrict the downloading of video/audio files.
Any violation of this section will result in the immediate suspension of the account and the filing of corresponding civil and criminal legal actions.
4. PRICES AND PAYMENTS
- Final Prices: The prices shown on the Platform are final and include applicable taxes (VAT) according to the current regulations of the consumer's country.
- Processing: Payment will be processed through the secure gateway Stripe. The Platform does not store or have access to the User's full banking data.
- Immediate Access: Access to the tour will be released automatically and immediately once the transaction is confirmed.
- Discounts and Promotions: The Platform may offer discounts, promotions, or special prices at certain times, without any obligation of prior notice or to extend such conditions to past or future purchases.
5. WITHDRAWAL POLICY (NO REFUNDS)
5.1. Exception to the Right of Withdrawal: In accordance with Art. 16(m) of Directive 2011/83/EU on consumer rights (and its transposition into local legislation), the User is informed and expressly accepts that:
As this is digital content not supplied on a tangible medium, the 14-day right of withdrawal is lost at the moment the performance of the content has begun (by pressing "play" or accessing the material).
5.2. Refund Policy: Therefore, returns or refunds will not be accepted for changes of mind, subjective dissatisfaction with the Guide's style, or User internet connection problems. Refunds will only be evaluated in cases of critical technical failure attributable to the App that prevents viewing the content.
6. CODES OF CONDUCT AND REVIEWS
Users may publish ratings and reviews of the tours. By doing so, the User guarantees that:
- Their opinion is based on a real experience.
- They will not use offensive, defamatory, hateful, or discriminatory language.
- They will not publish private data of the Guides.
RoamWithMe reserves the unilateral right to delete any review that violates these rules or is considered spam.
7. DISCLAIMER OF LIABILITY
The Platform acts as an intermediary service provider.
- Regarding Content: The Platform does not guarantee the historical accuracy, academic quality, or veracity of the information provided by the Guides. Opinions expressed in tours are the sole responsibility of their authors.
- Regarding Technical Failures: The Platform will not be responsible for service interruptions derived from failures in the User's internet connection, incompatibility of their mobile device, or force majeure causes.
- Regarding the Physical Experience of the Tour: The itinerary and directions provided in each tour are offered "as-is", as general guidance. The Platform cannot control real-world conditions (traffic, roadworks, weather, street conditions) and will not be liable for accidents, falls, theft, or other incidents that may occur while walking the route. As with any walk in a public space, the User's safety depends on their own judgment: please always follow official signage and traffic rules, even if they differ from what's indicated in the tour.
RoamWithMe is a digital content provider and does not act as a travel agency, event organizer, or insurance provider. The User assumes full responsibility for their safety, health, and personal belongings during the tour.
8. DATA PROTECTION
The User's personal data will be treated in accordance with the General Data Protection Regulation (GDPR). Your profile data (name and image) will be visible publicly only if you decide to leave a review or question. For more information, please consult our Privacy Policy on the web.
9. APPLICABLE LAW AND JURISDICTION
These conditions shall be governed by common Spanish legislation.
For the resolution of any controversy:
- If the User has the status of a consumer (according to EU regulations), the parties submit to the courts and tribunals of the User's domicile.
- If the User acts as an entrepreneur or professional, the parties expressly waive their own jurisdiction and submit to the courts and tribunals of Vilanova i la Geltrú (Barcelona).

For any claim or request for information, the User should preferably address the email address indicated.
Reporting Illegal Content: In accordance with Regulation (EU) 2022/2065 (Digital Services Act), any User may report content they consider illegal by writing to hello@roamwithme.app. We commit to reviewing and responding to such reports within a maximum of 72 hours.
Online Dispute Resolution (ODR): In accordance with Regulation (EU) 524/2013, we inform you that you may access the European online dispute resolution platform at: https://ec.europa.eu/consumers/odr. Our contact email for ODR purposes is hello@roamwithme.app.
11. MODIFICATIONS TO THESE TERMS
RoamWithMe may modify these Conditions at any time. When a change occurs, the new terms will be presented to you the next time you access the App, and you must expressly accept them in order to continue using the Platform. If you do not accept the new terms, you may delete your account.
PRIVACY POLICY

At RoamWithMe, we take the privacy of your data very seriously. This Privacy Policy describes how we collect, use, and protect the personal information of Users and Guides who use our platform.
1. DATA CONTROLLER
The party responsible for the processing of your personal data (Data Controller) at RoamWithMe is:

2. DATA WE COLLECT
Depending on how you interact with the platform (as a Traveler User or as a Creator Guide), we process different categories of data:
A. User Data (Travelers):
- Identity Data: Name, email address, profile picture, and password (encrypted).
- Transactional Data: Purchase history and unlocked tours.
- Financial Data: RoamWithMe does not collect or store your full credit card number. This data is processed securely and exclusively by our payment provider, Stripe.
B. Collaborator Data (Guides):
- Public Profile: Real or artistic name, profile picture, and biography. Important: By registering as a Guide, you accept that this data will be publicly visible on the Marketplace to promote your tours.
- Tax and Payment Data: Data necessary to execute the transfer of your commissions (bank account or Stripe Connect account) and for invoicing purposes.
C. Navigation Data (All):
- IP address, device type, operating system, and connection logs to guarantee App security and prevent fraud.
- Cookies (web only): RoamWithMe's website uses first-party and third-party cookies for analytics and functionality. You can manage your consent through the cookie preference panel available on the website. The mobile App does not use cookies, but uses device identifiers and analytics SDKs for the same purposes.
- Location (GPS): If you grant us permission, we access your real-time location to show you tours available near you. This location is processed on the spot for this feature and is not permanently stored on our servers.
3. PURPOSE AND LEGAL BASIS
We process your data for the following purposes and legal bases (according to Art. 6 of the GDPR):

4. DATA RECIPIENTS (WHO SEES IT?)
Your personal data will not be transferred to third parties, except under legal obligation. However, to provide the service, we share strictly necessary data with technology providers ("Data Processors") acting under our instructions:
- Payments: Stripe Payments Europe, Ltd. (to process charges and payouts).
- Hosting and Infrastructure: Google Cloud / Firebase.
- Public Administration: Tax Agency (Hacienda) and competent bodies, only when legally required.
5. INTERNATIONAL TRANSFERS
Some of our providers (such as Stripe or hosting services) may process data outside the European Economic Area (EEA). In these cases, we guarantee that transfers are made under appropriate protection frameworks, such as the Data Privacy Framework (EU-US) or through the signing of Standard Contractual Clauses (SCCs) approved by the European Commission.
6. RETENTION PERIODS
We will keep your data while your account remains active.
- If you decide to delete your account, your data will be blocked and retained only for the time necessary to comply with legal obligations (tax and commercial), for a maximum period of 6 years.
- After this period, the data will be permanently deleted or anonymized.
7. YOUR RIGHTS (GDPR)
As the data subject, regulations grant you the following rights:
- Access: To know what data we hold about you.
- Rectification: To correct inaccurate data.
- Erasure (Right to be Forgotten): To ask us to delete your data (when it is no longer necessary).
- Objection and Limitation: To oppose a specific processing or request its limitation.
- Portability: To receive your data in a structured format.
To exercise these rights, send an email to hello@roamwithme.app with the subject line "DATA PROTECTION".
If you consider that we have not processed your data correctly, you have the right to file a claim with the Spanish Data Protection Agency (Agencia Española de Protección de Datos - www.aepd.es).
8. SECURITY
We implement technical and organizational security measures (HTTPS encryption, secure passwords, certified providers) to protect your data against unauthorized access, loss, or alteration.
9. CHANGES TO THIS POLICY
When we update this Policy, the new version will be presented to you in the App and you must expressly accept it in order to continue using the Platform.
